Dear Editor: Response to Roe V Wade Article

Dear Editor,

This is in response to the opinion of Rebecca Johnson in her article in the 6/29/2022 Whitehall Ledger edition.

Reading the articles on display after the ruling on Dobbs v Jackson which overturns Roe v Wade has shed some light on how uneducated the population is on the rule of law in this country.

The foundation of these laws lies in the Constitution of the United States. The recent ruling on Roe was a win for every freedom-loving American because it was a win for the Constitution. Because this issue strikes a moral nerve, many tend to overlook the facts at hand and lean toward a more Marxist ideal in debating the issue, others find it easier to just point fingers at the “villain” of the day like an “out-of-touch Supreme Court” or maybe “some well-intentioned men” who have no problem “retaining control over their bodies.” Hmmm, think about that one for a while!

That being said, here are a few things to ponder about the recent Supreme Court Dobbs v Jackson ruling. Truth cannot be exchanged for lies. The idea that abortion is covered in the Constitution is just not true. Everything that is not in the Constitution does not make it unconstitutional it just means that it goes to the States to decide. That is the law of the land.

Roe and Casey arrogated that authority therefore the Supreme Court’s action to overturn this case is in line with the tenth amendment and returns this authority to the people to resolve this issue in their state through their elected representatives. It is a blunt reminder that law is legislated and not handed down from the bench. This is stated clearly in the 213-page written decision that is worth the read and gives a history of how common law is the seed of our system of law today. These opinions are clearly written in language that is easy for every person to understand.

So, now the conversation will be brought to the states where the people will decide whether the sanctity of life and the dignity of the individual is paramount or if we will continue down the road to a utilitarian world for the collective. I will finish by asking my fellow Montanans to take the time to educate themselves in the rule of law so that this and future debates will be grounded in objective truth rather than emotion and opinion.
